Applicable To
Form 941 Form 1099 / W-2 Form 2290

If you miss filing Form 2290 or paying the HVUT, the IRS will impose a penalty. The IRS may also impose penalties for fraudulent returns and filing returns with false information.

The penalties for failure of filing Form 2290 and paying the HVUT are as follows:

  • If you fail to file Form 2290 before the deadline, a penalty of 4.5% of the total tax amount, assessed on a monthly basis for up to five months.
  • If you miss paying the HVUT before the deadline, there will be a monthly penalty of 0.5% of the total tax due. Also, additional interest charges of 0.54 percent per month will accrue.

The IRS will send you a notice for the penalty with instructions to pay penalties. It is recommended that you file your return before the deadline to avoid penalties and cancellation of your vehicle tag.

Note: The IRS may waive off your penalty if you show a reasonable cause for failure to file Form 2290 or pay the HVUT within the deadline.
